PORSCHE DRIVE - GIFT CARD PURCHASE AGREEMENT AND TERMS OF USE

  1. General provisions.
  2. This gift card purchase agreement and terms of use ("Purchase Agreement") are concluded between the buyer ("Buyer") and OÜ Auto 100 Rent (registration code no. 10694908; address Tallinna tn 45, Viljandi, Estonia) ("Seller").
  3. This Purchase Agreement is also subject to the Seller's general terms and conditions, as far as this Purchase Agreement does not regulate otherwise. The Seller's General Terms and Conditions are available on the Seller's website (https://porschedrive.ee/en/legal/policy/3) and in the office ("General Terms and Conditions").   4. Content of the purchase agreement.
  5. With the purchase agreement, the Seller undertakes to hand over to the Buyer a gift card in the amount chosen by the Buyer, and the Buyer undertakes to pay for it accordingly. The Seller hands over the gift card to the Buyer electronically or in paper form at the office. The owner of the gift card has the right to use the gift card during its validity period to pay for receiving services from the Seller.
  6. Terms of use of the gift card.
  7. The gift card can be used to pay for receiving a service from the Seller. The gift card (electronic or paper) must be presented to the Seller before ordering the service.
  8. The gift card can only be used once.
  9. If the Seller's service fee exceeds the amount indicated on the gift card, the owner of the gift card must pay the missing amount additionally. If the fee for the service is less than the amount indicated on the gift card, the Seller will not return the unused amount and it cannot be used to pay for the service the next time.
  10. The buyer cannot exchange the gift card for cash.
  11. The gift card must be used within its validity period. The validity period of the gift card is indicated on the gift card. The gift card is valid for 12 months from the date of purchase.
  12. If the validity period of the gift card has expired, the gift card loses its validity, and the owner of the gift card does not have the right to use the gift card to pay for the service from the Seller. The owner of the gift card may not submit other claims, including the return of the gift card amount.
  13. The buyer can transfer the gift card to a third party. The buyer has the obligation to ensure that the new acquirer of the gift card is aware of and agrees to the conditions stated in this Purchase Agreement (including the terms of use of the gift card).
  14. The user of the gift card (electronic or paper gift card) is considered the owner of the gift card, who has the right to pay for the Seller's service up to the amount indicated on the gift card. The seller is not responsible if the user of the gift card has not validly acquired the gift card or does not have the right to use it.
  15. The owner of the gift card bears the risk of its loss. The seller is under no obligation to give the gift card owner a new gift card if the gift card is lost or leaves the owner's possession for any other reason (including against their will).
  16. If the user of the gift card legitimately withdraws from the Reservation or Rental Agreement, for which he used the gift card to pay, before the Rental Item is put into use by the Renter, the parties will return the proceeds based on the agreement, including the Seller returning the gift card to the Buyer. If the user of the gift card cancels the Booking according to point 6 of the General Terms and Conditions, the Lessor will return the gift card to the Renter in the amount deducted in point 6.1 of the General Terms and Conditions. stated Cancellation fee.
  17. Entry into force of the purchase agreement and withdrawal from it.
  18. This agreement comes into force from the moment when the Buyer has made the payment and the Seller has confirmed the purchase by sending the gift card electronically to the (e-mail) address indicated in the Buyer's order form or by handing it over to the Buyer on site at the office.
  19. As a consumer, the Buyer confirms that he agrees to the provision of services, etc., and confirms that upon performance of the contract, he loses the right of withdrawal provided for in § 56 (1) of the Law of Obligations Act.
  20. Final provisions.
  21. Disputes, disagreements and claims arising from or related to this agreement shall be resolved in the Harju County Court (Tallinn, Estonia).
  22. As a consumer, the Buyer has the right to file a complaint with the Seller, contact the Consumer Protection and Technical Supervision Board, and file a complaint with the Consumer Disputes Committee.
